Without regard to principles of conflict of laws, the laws of the State of Illinois shall govern the Program and any claim or dispute that has arisen or may arise between you and Ace.

Taxes: Any federal, state, local, or other governmental fees that may be imposed in connection with the Program are the sole responsibility of the Program members.

No rights under these Program Terms will be waived by Ace as a result of any delay or failure to enforce any of them.

Severability: If any provision(s) of these Program Terms are found to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision. These Program Terms shall be construed in accordance with their terms as if the invalid or unenforceable provision were not present therein in the event that any provision of these Program Terms is determined to be invalid or unenforceable.

Construction: These Program Terms’ headings are included only for convenience and do not affect how any of their provisions should be interpreted. They are not a part of this agreement. Any reference to the term “including” means “including, without limitation. “All currency references are expressed in US dollars.

Survival: In the event that your Program Account is terminated or the Program is canceled, the provisions relating to the disclaimer of warranties, limitation of liability, arbitration agreement, prohibition of class and representative actions, non-individualized relief, and these other provisions shall survive.

A special invitation code (“Invitation Code”) will be given to current Program members who choose to take part in the Ace Rewards Referral Friend Bonus Points Offer (“Referral Offer” in the App) in order to share it with friends and family who are not yet Ace Rewards members (“Non-members”). You are attesting that you satisfy all requirements for eligibility by enrolling in the Program. Additionally, if you are enrolling on behalf of a business entity, you are attesting that you have the right to bind the entity to these Terms and that you have done so.

You can sign up for the Program by creating an Ace Rewards Program account (“Program Account”) in one of three ways: (i) in person at a participating Ace Hardware retail location (a “Participating Retailer”); (ii) using the App, which can be downloaded from the Apple® App Store for iOS devices and the Google PlayTM store for AndroidTM devices; or (iii) by filling out the Program enrollment form online. acehardware. com/ace-rewards. Residents of Puerto Rico cannot enroll in the Program through the Online Services; instead, they must enroll at a Participating Retailer. You must provide all necessary details, including your full name, your business name (if applicable), a working mailing address, and your phone number. Additional required information may be identified during the enrollment process. Each Program member may only have one Program Account, and Ace may decide to close any extraneous Program Accounts. It is not necessary to have a Program Card in order to participate in the Program or receive Program Benefits, though Ace may choose to give you one. One or more Program Cards may be given to you when you enroll at a Participating Retailer. One or more Program Cards may be mailed to the mailing address connected to your Program Account if you enroll in the App or on the website.

You agree to notify us right away if you become aware of any unauthorized activity connected to your Program Account. You are accountable for all transactions made using your Program Card and/or Program Account. Please get in touch with customer service if you want to replace your program card or get more cards.

By making eligible purchases on the Site, through the App, or at Participating Retailers, Members accumulate Program points (“Points”). Please be aware that members who are in Puerto Rico or whose assigned retailer is there will not be able to make purchases through the website or mobile application. Ten (10) Points will accrue for every $1. 00 spent on eligible purchases, deducted from any discounts, coupons, Instant Savings, Red Hot Buy, reward redemption, in-store promotions, and/or other price adjustments applied at the time of purchase. For any returns, credits, refunds, chargebacks, or voided transactions, neither new nor previously awarded Points will accrue.

For the purpose of earning Points, qualifying purchases are those that do not include the following: (i) taxes; (ii) gift cards; (iii) charitable contributions; (iv) service fees; (v) any goods purchased from Participating Retailers’ non-Ace businesses; (vi) any goods that Ace, in its sole discretion, elects to exclude from time to time; (vii) any goods that a Participating Retailer, in its sole discretion, elects to exclude from time to time; Some participating retailers may allow Points to be awarded for the purchase of prohibited items, and additional exclusions may apply. Points will not be given out retroactively unless Ace permits it in its sole discretion on an individual basis. You must show your Program Card or the phone number connected to your Program Account when making a qualifying purchase at a Participating Retailer. There might be a space for your Program Account number at the bottom of the store receipt. However, just because your Program Account number is on the receipt does not imply that all of the items therein, or even any of the items therein, were qualifying purchases. At the time of the purchase, you must have and be logged into an Ace Hardware Account that is linked to your Program Account (“Linked Ace Hardware Account”) in order to earn Points for qualifying purchases made on the Site or in the App.

Additionally, Ace may choose to award Points occasionally in connection with Member Offers (as defined below), such as the Ace Rewards Refer a Friend and Get a Bonus Points Offer described below.

To receive a Program reward (a “Reward”), you must accumulate at least 2,500 Points. You will get a $5 reward after accumulating 2,500 points. 00 off the purchase price of eligible merchandise. If you earn multiple Rewards at once (due to accumulating 5,000 or more Points), the Rewards may be combined into one Reward or Ace may choose, in its sole discretion, to divide the total value of the Rewards into multiple Rewards in denominations of Ace’s choosing, provided that all Rewards are issued in multiples of $5. 00. Rewards are processed the week that the required 2,500 Points is reached. Your Program Account will automatically deduct points for any issued Rewards. You are unable to choose to receive a reward instead of keeping your points in your program account. Rewards are available in print and digital formats, as detailed below, but they all belong to one single reward that can only be used once. This includes any permitted copies as well as the digital and print formats.

Digital Rewards: On or around Monday, a digital reward (“Digital Reward”) will be issued to Program Accounts with more than 2,500 Points on Sunday. Members who live in Puerto Rico or whose assigned participating retailer is there are not eligible to redeem digital rewards because they require a linked Ace Hardware account. Digital Rewards can be used on the site or in the app, but you can only use a maximum of $99 toward orders that are entirely paid for with redeemed Rewards and that include one or more items that will be delivered to your home or another specified address. 99 in Rewards per order. Print Rewards: In the event that a Digital Reward is not claimed by the end of the month following its issuance, Ace will mail a physical print reward (a “Print Reward”) to the mailing address connected to your Program Account, provided that we have your current postal address on file. Despite the aforementioned, your Print Rewards will be sent to your Assigned Participating Retailer (defined below) rather than to you if (i) they are requested by your Assigned Participating Retailer and we do not have a current mailing address for you; (ii) they are requested by your Assigned Participating Retailer and the Print Rewards are worth more than $24. 99 or more; or (iii) the Print Rewards’ value is at least $100. Except if you are a resident of Puerto Rico or your Assigned Participating Retailer is situated in Puerto Rico, your Digital Reward will still be redeemable even if your Print Reward is mailed to your Assigned Participating Retailer (see the section above on digital rewards redemption). The Participating Retailer listed on the Print Reward is where a Print Reward can be redeemed. Additionally, other Participating Retailers may accept Print Rewards at their sole discretion.

Rewards can only be used to buy eligible items when they are redeemed in-store, online, or through the app. The following items are not considered eligible: (i) services provided by Ace stores, such as rentals, in-store services, and extended warranties; (ii) gift cards; (iii) trash bags, city stickers, and other licenses and permits; (iv) lumber and building supplies; (v) alcohol, tobacco, firearms, and fuel; (vi) payments on account, such as house accounts; (vii) previously owned goods; and (viii) taxes. There may be additional exclusions, and some participating retailers may allow the use of Rewards on prohibited items. See your Assigned Participating Retailer for details. Additionally, Ace may, but is not required to, allow online Rewards redemption on prohibited items.

Rewards are valid for a single transaction only. You may combine multiple Rewards with an eligible purchase, subject to any restrictions stated in these Program Terms. Rewards can be used in conjunction with other offers, barring any restrictions imposed by those other offers’ terms. No change will be made and the remaining balance of the Reward(s) will be forfeited if the value of the Reward(s) used exceeds the purchase price of eligible goods, before tax. Photocopies, duplicates, and facsimiles of Print Rewards are not valid. However, if a Program member uses a Reward toward an online order of eligible goods and the order is canceled before fulfillment, Ace will issue to the Program members Program Account Points equal to the value of such Reward. Rewards are distributed pro rata across all eligible goods and will not be replaced if eligible goods are returned. Rewards may be used up until the date of expiration, unless they are used up earlier.

Ace may occasionally provide additional benefits to Program participants at its sole discretion. These additional benefits may include:

  • Instant savings in-store, on the Site and/or in the App. Instant savings are subject to product availability. Not all Participating Retailers offer all instant savings. For any specific conditions, restrictions, and/or exclusions, including redemption options and expiration dates, see each instant savings offer.
  • With qualifying online purchases of $50 or more, store delivery is free. Members of the program are entitled to free next-day delivery on in-stock purchases with a subtotal of $50 or more (before Rewards redemption and taxes). Exclusions apply. If a product is eligible for free delivery from store, check the product page on the website or in the mobile app. Free delivery is not available in Puerto Rico. Free shipping is for the following business day and does not apply to same-day delivery or ship to homes. Some participating retailers charge for delivery, while others have restricted delivery zones and/or delivery merchandise.   • Offers and coupons exclusively for Program members. Ace may choose to make limited-time offers, discounts, or promotions (collectively, “Member Offers”) available to Program members on occasion. Member Offers may consist of discount coupons and bonus Point awards, but not only. Members may not be offered or awarded Member Offers, which are made at Aces’ sole discretion and are subject to the Member Offer’s terms. Ace has the right to discontinue Member Offers at any time, with or without notice; however, Member Offers with an expiration date will, absent fraud or other misconduct, continue to be valid through that date. To use Program Benefits, you might need to provide proof of Program membership. To ensure you receive program benefits, kindly maintain your program account information, including your mailing address, email address, and birth month.

Ace Rewards Premier Eligibility and Expiration: Program members who have a qualifying spend of $750 or more (exclusive of taxes, applied Rewards, and discounts) in a rolling twelve (12) month period while a member of the Ace Rewards Program are automatically eligible for Ace Rewards Premier status; however, corporate/business Program members and Program members with store house accounts are not eligible for Ace Rewards Premier status. When making in-store purchases, Program members must show their Rewards Card or number, and when making purchases on the Site or in the App, they must be signed in to their Linked Ace Hardware Account. Approximately one to two months after the end of the calendar quarter in which they became eligible for Ace Rewards Premier status, program members for whom we have a valid mailing address will be notified by mail. Contacting Customer Service will provide details on how to become an Ace Rewards Premier member. After the end of the calendar quarter in which you met the requirements for Ace Rewards Premier status, your status expires after one year. If they continue to meet the requirements for Ace Rewards Premier eligibility after the one-year period has ended, Program members may requalify for Ace Rewards Premier status for additional one-year terms.

Benefits of Ace Rewards Premier Status: Occasionally, we will mail special printed offers and coupons (referred to as “Ace Rewards Premier Coupons”) to Program members who have attained Ace Rewards Premier status and for whom we have a current mailing address. Ace Rewards Premier Coupons must be redeemed at the Participating Retailer listed on the coupon, though other Participating Retailers may accept them at their sole discretion. Program participants who have downloaded the App, have Linked Ace Hardware Accounts, and have Ace Rewards Premier status occasionally receive exclusive offers and coupons (collectively, “Ace Rewards Premier App Extras”). For details on the redemption channel, consult the terms of each Ace Rewards Premier App Extra. The type, quantity, and frequency of Ace Rewards Premier Coupons and Ace Rewards Premier App Extras (collectively, “Ace Rewards Premier Offers”) are decided solely by Ace, who may make changes at any time with or without prior notice to you. It’s possible that not all Ace Rewards Premier members will be able to access all Ace Rewards Premier Offers. All program benefits (collectively, “Program Benefits”) are subject to (i) the exclusions, conditions, and limitations set forth in these program terms, (ii) the availability of the benefit, and (iii) the terms that are specific to that benefit. For any specific conditions, exclusions, restrictions, and/or channels for redemption, as well as expiration dates, see each Program Benefit. Program Benefits are void where prohibited.

Not all Program Members might be eligible for all Program Benefits. At their discretion, Participating Retailers may change the Program and the Program Benefits. There is no cash value for points, rewards, member offers, Ace Rewards Premier offers, or any other program benefits. They also cannot be exchanged for cash in whole or in part, and they have no value outside of the program. Unredeemed lost or stolen Print Rewards that have not expired may be replaced at our discretion, but we are not required to. You do not acquire any vested rights to Points, Rewards, or any other Program Benefits through the accumulation of Points.

A member’s Program membership, Program Account, Program Card, and Program Benefits are only for the use of the named Program member and cannot be sold, shared, assigned, bartered, or otherwise transferred; however, if a Member Offer or Ace Rewards Premier Offer is expressly transferable, members may do so in accordance with the terms of the offer. Unless specifically stated in a valid and final court order sent to Ace, the named Program member keeps all Program Benefits in the event of a divorce. Except as otherwise required by law, all Program Benefits remain non-transferable in the event of a Program Member’s death.

Ace will choose a Participating Retailer for you if you register for the Program through the Site or the App based on the mailing address connected to your Program Account (“Assigned Participating Retailer”). If you sign up for the Program at a participating retailer, that retailer will serve as your assigned retailer. Based on your shopping preferences, the participation of the store in the Program, or other factors, Ace may occasionally change the Assigned Participating Retailer you are assigned to. Unless you make a purchase at another Participating Retailer in the interim, you will be assigned to the closest Participating Retailer based on zip code if your Assigned Participating Retailer stops taking part in the Program. You may receive a mail or email communication from Ace informing you of a change to your Assigned Participating Retailer, but Ace is not required to do so. Contact customer service if you need assistance locating your assigned participating retailer. You can ask for a change in your assigned participating retailer by contacting customer service, but any such change will only apply to Rewards and other Program Benefits that will be processed in the future. It will not apply to Rewards or other Program Benefits that have already been processed.

The truthfulness and completeness of the data you provide in connection with your Program Account are solely your responsibility. Program Benefits could be lost if your program account information is not kept up to date and accurate. By contacting customer service, you can access and update your information as well as check the status of your program account, including the number of points you’ve earned. By logging into your Linked Ace Hardware Account on the Site, you can also access and update some Program Account information online. Additionally, you can update some Program Account data in the App. Please be aware that using the Site or App to manage Program Accounts will not be an option for Puerto Ricans.

You can close your Program Account whenever you want by getting in touch with Customer Service.
